By accessing or using the Tank Heating Calculator (“the Application”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Application. The Application is provided by KHouse Holdings LLC (“we,” “us,” or “our”).
The results produced by this Application are engineering estimates only. They are not engineering certifications, sealed calculations, or professional engineering opinions. All outputs are approximate and based on simplified thermal models, empirical correlations, and user-supplied inputs.
This Application is not a substitute for professional engineering review. All designs, equipment selections, and operational decisions based on results from this Application must be independently verified by a qualified professional engineer licensed in the applicable jurisdiction. We make no warranty that the calculations are suitable for any particular application or that they meet any applicable codes or standards.

We do not guarantee the accuracy, completeness, or currency of any third-party data. Data sources may change, become unavailable, or contain errors without notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHOUSE HOLDINGS LLC ASSUMES NO LIABILITY FOR ANY DECISIONS MADE, DAMAGES INCURRED, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSSES ARISING FROM THE USE OF THIS APPLICATION OR ITS OUTPUTS.
This includes, without limitation, liability for: incorrect equipment sizing, thermal design failures, product degradation, tank or piping system damage, safety incidents, regulatory non-compliance, or any consequential, incidental, or indirect damages. Use of this Application is entirely at your own risk.

You must be at least 18 years of age to use this Application. By using the Application, you represent and warrant that you are at least 18 years old. If we discover that a user is under 18, we will promptly terminate their account and delete their information.
The Application is currently in beta testing. Beta access is granted at our sole discretion and may be revoked at any time. Beta software may contain bugs, produce incorrect results, or experience downtime. You acknowledge these risks by participating in the beta program.

All content, calculation methods, user interface designs, and software code in this Application are the property of KHouse Holdings LLC and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
The Application integrates with third-party services including Open-Meteo (weather data), Supabase (authentication and data storage), and Cloudflare Workers (hosting). Your use of the Application is also subject to the terms and privacy policies of these providers. We are not responsible for the availability or accuracy of third-party services.
We reserve the right to suspend or terminate your account at any time, with or without cause or notice. You may also terminate your account at any time by contacting us. Upon termination:
We may update these Terms at any time. Changes will be indicated by an updated effective date. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated via the Application.
Before initiating any formal proceeding, you agree to contact us at scott@bluewatervision.net to attempt to resolve the dispute informally for at least thirty (30) days.
If informal resolution fails, either party may initiate mediation administered by JAMS or a mutually agreed mediator in Pender County, North Carolina. Each party shall bear its own mediation costs, and the mediator's fees shall be shared equally.
If mediation does not resolve the dispute within sixty (60) days, either party may initiate binding arbitration under the rules of JAMS in Pender County, North Carolina. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
Either party may bring an individual action in small claims court in Pender County, North Carolina, if the claim qualifies.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Pender County, North Carolina.
