Terms of Use

1. Acceptance of Terms

By accessing or using the Tank Heating Calculator (“the Application”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Application. The Application is provided by KHouse Holdings LLC (“we,” “us,” or “our”).

2. Calculation Disclaimer

The results produced by this Application are engineering estimates only. They are not engineering certifications, sealed calculations, or professional engineering opinions. All outputs are approximate and based on simplified thermal models, empirical correlations, and user-supplied inputs.

This Application is not a substitute for professional engineering review. All designs, equipment selections, and operational decisions based on results from this Application must be independently verified by a qualified professional engineer licensed in the applicable jurisdiction. We make no warranty that the calculations are suitable for any particular application or that they meet any applicable codes or standards.

3. Data Sources & Accuracy

The Application uses data from the following sources:

• Weather data: Historical climate data from the Open-Meteo API, which aggregates data from NOAA, the National Weather Service, and other meteorological agencies. Weather data represents historical averages and may not reflect future conditions.
• Product properties: Thermophysical properties (density, specific heat, thermal conductivity, viscosity) sourced from publicly available engineering references including the NIST Chemistry WebBook, CRC Handbook of Chemistry and Physics, NOAA CAMEO Chemicals, manufacturer safety data sheets, and published engineering literature.
• Calculation methodology: Heat loss models are based on standard engineering practice including ASTM C680, Globe & Dropkin (1959) natural convection correlations, LMTD heat exchanger sizing methods, and published industry reference methods.
• Equipment data: Manufacturer specifications from publicly available product catalogs and technical datasheets.

We do not guarantee the accuracy, completeness, or currency of any third-party data. Data sources may change, become unavailable, or contain errors without notice.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHOUSE HOLDINGS LLC ASSUMES NO LIABILITY FOR ANY DECISIONS MADE, DAMAGES INCURRED, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSSES ARISING FROM THE USE OF THIS APPLICATION OR ITS OUTPUTS.

This includes, without limitation, liability for: incorrect equipment sizing, thermal design failures, product degradation, tank or piping system damage, safety incidents, regulatory non-compliance, or any consequential, incidental, or indirect damages. Use of this Application is entirely at your own risk.

5. User Responsibility

You are solely responsible for:

• Verifying all calculation results independently before use in design or operations
• Ensuring all inputs (dimensions, temperatures, product properties) are accurate and appropriate
• Confirming that designs comply with all applicable codes, standards, and regulations (API 650, ASME, NFPA, etc.)
• Engaging qualified professional engineers for final design review and approval
• Maintaining the confidentiality of your account credentials

6. Age Requirement

You must be at least 18 years of age to use this Application. By using the Application, you represent and warrant that you are at least 18 years old. If we discover that a user is under 18, we will promptly terminate their account and delete their information.

7. Beta Program

The Application is currently in beta testing. Beta access is granted at our sole discretion and may be revoked at any time. Beta software may contain bugs, produce incorrect results, or experience downtime. You acknowledge these risks by participating in the beta program.

8. User Conduct

You agree not to:

• Use the Application for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the calculation engine
• Use automated tools to scrape, crawl, or overload the Application
• Share your account credentials with unauthorized parties
• Misrepresent the Application's outputs as certified engineering calculations

9. Intellectual Property

All content, calculation methods, user interface designs, and software code in this Application are the property of KHouse Holdings LLC and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Third-Party Services

The Application integrates with third-party services including Open-Meteo (weather data), Supabase (authentication and data storage), and Cloudflare Workers (hosting). Your use of the Application is also subject to the terms and privacy policies of these providers. We are not responsible for the availability or accuracy of third-party services.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice. You may also terminate your account at any time by contacting us. Upon termination:

• Your cloud account data (email, preferences, access records) will be deleted.
• Any locally stored configuration files, calculation inputs, and generated PDF reports remain on your device and must be deleted by you.
• We do not have access to files stored on your device and cannot delete them on your behalf.

12. Modifications to Terms

We may update these Terms at any time. Changes will be indicated by an updated effective date. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated via the Application.

13. Dispute Resolution

Informal Resolution

Before initiating any formal proceeding, you agree to contact us at scott@bluewatervision.net to attempt to resolve the dispute informally for at least thirty (30) days.

Mediation

If informal resolution fails, either party may initiate mediation administered by JAMS or a mutually agreed mediator in Pender County, North Carolina. Each party shall bear its own mediation costs, and the mediator's fees shall be shared equally.

Binding Arbitration

If mediation does not resolve the dispute within sixty (60) days, either party may initiate binding arbitration under the rules of JAMS in Pender County, North Carolina. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Small Claims Exception

Either party may bring an individual action in small claims court in Pender County, North Carolina, if the claim qualifies.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Pender County, North Carolina.
